Courts have identified seven key elements in procedural due process; 1. Notice 2. A neutral decision-maker 3. An opportunity to make an oral presentation 4. The opportunity to present evidence 5. The opportunity to cross-examine witnesses and respond to evidence 6. Right to representation by counsel 7. A decision based on the record, and reasoning for the result. HB 5448 does not do this; rights are taken away first. This is why I’m strongly opposed to HB 5448 AN ACT CONCERNING A RISK PROTECTION ORDER OR WARRANT. I’m in strong support of HB 5390 AN ACT CONCERNING THE DUTY TO RETREAT IN A HOUSE OF RELIGIOUS WORSHIP. I’m in strong support of HB 5432 AN ACT CONCERNING NONLETHAL ELECTRONIC DEFENSE WEAPONS.
